What Sellers Don't Know — Until It's Too Late

Selling property in Israel is not simply a matter of finding a buyer and transferring ownership. There are legal and financial obligations on the seller's side that can significantly affect what you actually receive.

Capital gains tax (Mas Shevach) can take a significant portion of your profit — and the calculation isn't always what sellers expect
A betterment levy (Hetel Hashbacha) may be charged by the municipality if building rights on the property increased — even if you never built anything
An existing mortgage must be formally discharged through the bank — a process that can delay closing if not handled in advance
The purchase contract is drafted by the buyer's attorney to protect the buyer — every clause, deadline, and penalty favors the other side
Unlicensed additions or structures on the property can give the buyer grounds to demand a price reduction or walk away from the deal
If you're selling from abroad, transferring the net proceeds to your overseas bank account requires proper legal and tax clearance from Israeli authorities

Full Legal Representation — From First Offer to Final Payment

Attorney Shimony represents sellers exclusively in each transaction, with one goal: maximizing your net proceeds while protecting you from liability.

Tax Planning Before You Sign

We calculate your capital gains tax exposure and any betterment levy before you agree to a price — so you know exactly what you will net. We also assess whether you qualify for a capital gains tax exemption (such as the single-apartment exemption) and structure the transaction to legally minimize your tax liability from the outset.

Contract Drafting & Negotiation

We draft the sale agreement in your favor — setting payment terms, conditions, and penalty clauses that protect you if the buyer delays or defaults. When the buyer's attorney pushes back with demands or amendments, we negotiate every line on your behalf, in Hebrew, so nothing slips through that shouldn't.

Closing, Discharge & Funds Transfer

We coordinate the mortgage discharge with your bank, file all required tax declarations with the Israel Tax Authority, manage the Land Registry transfer, and ensure the full net proceeds reach your account — in Israel or abroad — cleanly documented and legally cleared.

The Seller's Tax Obligations in Israel

These need to be understood and planned for before negotiations start — not after you've agreed on a price.

Capital Gains Tax (Mas Shevach)

Paid by the seller on the appreciation of the property since the date of purchase. The rate and exact amount depend on when you bought, how long you've held it, and your residency status. Exemptions exist — most notably for owners selling their sole residential apartment. We assess your eligibility before you list.

Seller's Obligation

Betterment Levy (Hetel Hashbacha)

Charged by the local municipality when the planning value of a property increased — for example, due to rezoning or added building rights. Many sellers discover this levy only when they try to close. We check for outstanding betterment assessments early, before they become a last-minute obstacle.

Agent Fees & Attorney Fees

Real estate agent fees in Israel are typically borne by the seller as a percentage of the sale price. Legal fees are separate. We give you a transparent fee structure before we begin — so you can calculate the full cost of the sale and price the property accordingly, with no surprises at closing.

How We Handle Your Sale — 4 Stages

Structured, transparent, and managed in Israel — you stay informed in English from first consultation to final payment.

1

Tax Assessment

Before you set a price or accept an offer, we calculate your full tax exposure — capital gains, betterment levy, fees — so you know your net proceeds from day one.

2

Contract Preparation

We draft the sale agreement in your favor and negotiate against the buyer's attorney, protecting your price, your timeline, and your right to keep the deposit if the deal falls through.

3

Pre-Closing Clearance

We obtain tax clearance certificates, coordinate mortgage discharge with your bank, resolve any outstanding municipal levies, and prepare everything needed for a clean transfer.

4

Payment & Registration

We release the final payment, file all tax declarations with the Israel Tax Authority, complete the Land Registry transfer, and confirm the net proceeds reach your account — in Israel or abroad.
